Attorney Gary Aguirre guest starred last month at a Senate hearing on hedge fund and took the occasion to complain that his former agency, the Securities and Exchange Commission, fired him for getting a little too close for comfort to a big Wall Street name while investigating alleged insider trading at Pequot Capital Management. That probe reportedly could have involved subpoenaing John Mack of Morgan Stanley, and Aguirre wants to prove that the SEC gave “favored, special and thus unlawful treatment to an individual, who has powerful political connections in an SEC investigation.” To prove his point, Aguirre has filed a Freedom of Information Act action to get access to the files that would support his assertion. Since abruptly ending that investigation – and Aguirre’s employment – the SEC has not charged anyone or even confirmed there is an ongoing investigation. SEC spokesman John Nester would tell Reuters only, “Any suggest that preferential treatment was sought or given during the course of an investigation is absolutely without merit.”
