Nothing like hitting a guy when he’s down, and these days there are few entitled to be in low spirits than former Refco CEO Phillip Bennett. If the current Refco mess isn’t enough, Bennett may also face charges that date to years before the futures brokerage’s initial public offering, which got the snowball rolling last August. For now, Bennett has no idea what transactions prosecutors are focusing on, Dow Jones reports, though apparently they promise to spell it all out in a future, revised indictment. Lawyers for Bennett are asking the court to force the prosecutors to detail now those transactions – which they believe are part of his conspiracy to conceal bad debts – so that they can prepare a defense for their client. “If the government continues to believe that Mr. Bennett received $700 million in illicit proceeds, then the bill of particulars it has provided is incomplete,” say the lawyers, “and we ask that the government be required to supplement it by identifying additional accounts or other assets its believes are subject to forfeiture.”
