It used to be that brokers who were barred from the securities industry would seek the unregulated safety of hedge funds by launching one, but since HF adviser registration is now law, they can try to run to hedge funds but can't hide anymore. Form ADV, the registration form that requires a host of basic information about a firm, according to The Wall Street Journal, also contains a section that requires details of any past criminal felony charges or past regulatory run-ins as part of the Securities and Exchange Commission's approval process. That info is out there for all to see on the SEC Web site at www.adviserinfo.sec.gov, so former wrongdoers who went on to launch hedge funds may not be able to do so as easily. Applicants turned down because of their past criminal record, however, may request a hearing. Form ADV has elicited information that is less serious than meets the eye but still could spell trouble for some. For example, The WSJ reports, Andor Capital Management listed one of its staffers with a record for criminal activity. The heinous crime? Underage drinking while the junior employee was in college.
